Justice Secretary Kenny MacAskill resisted an opposition call to back the recovery of assets from a fraudster represented by Deputy First Minister Nicola Sturgeon.
Mr MacAskill told Labour MSP Hugh Henry, a former deputy justice minister, that it would be "inappropriate" for him to comment on an individual case.
Ms Sturgeon, in her role as constituency MSP for Glasgow Govan, wrote to a court on behalf of benefits cheat Abdul Rauf asking them to consider alternatives to custody.
